This Terms & Conditions document forms part of every Rental Agreement entered into with KYN Hauling LLC ("KYN"). By signing the Rental Agreement, the Customer acknowledges that they have read, understood, and agreed to be bound by all terms set forth in this document, including the Fee Schedule, Prohibited Items list, and Usage Policies. This document is provided to the Customer at the time of booking or delivery, and is available at any time upon request. The most current version is the version in effect at the time of the Customer's rental.

1. The Customer signs a Rental Agreement for each rental.
2. This Terms & Conditions document governs every rental.
3. The Pickup Condition Report (signed at pickup) confirms final charges.

1. Complete Fee Schedule

All fees in this schedule form part of the Rental Agreement. The Customer is responsible for all applicable charges incurred during the rental period.

Concrete, sod, and dirt are handled exclusively by the dedicated 10-Yd HD unit (planned to join the fleet ~October 2026). Until that unit is in service, these materials cannot be accepted in any container. The 20-yard dumpster does not accept concrete, sod, or dirt.

2. Prohibited & Restricted Items

Important warning. Placing any of the following items in a KYN dumpster may result in a $250 Landfill Rejection Fee and/or refusal of haul. The Customer accepts full financial responsibility for any prohibited items found in the load. The following categories are PROHIBITED from being placed in any KYN rental dumpster, regardless of pricing tier or rental type.

When in doubt — ask first. Many items not listed above may still be restricted. If the Customer is unsure whether an item is allowed, they must call KYN before placing it in the dumpster.

3. Usage Policies & Customer Responsibilities

The following policies govern the Customer's use of any KYN dumpster during the rental period. Violation of these policies may result in additional charges, refusal of service, and/or liability for damages.

3.1 Placement & Delivery
3.1.1 Surface Requirements.

The Customer must provide a flat, hard surface suitable for the weight of the dumpster (loaded weight can exceed 8,000 lbs). Soft sod, decorative pavers, and unmaintained driveways may sustain damage and the Customer assumes this risk.

3.1.2 Protective Boards.

KYN places wooden boards under the dumpster to minimize surface damage when requested ($25; free for repeat customers), but cannot guarantee zero impact on driveways, especially asphalt softened by Florida heat.

3.1.3 Access Requirements.

The Customer is responsible for ensuring at least 60 feet of straight, unobstructed access from the street to the placement location, with overhead clearance of at least 22 feet (no low branches, wires, or eaves).

3.1.4 Permits.

Dumpster placement on private property generally does not require a permit. Placement on a public street or right-of-way may require municipal approval, which is the Customer's responsibility, not KYN's. The Customer should confirm current requirements with the city before delivery and provide any required permit prior to delivery.

3.2 Loading Requirements
3.2.1 Fill Limits.

The Customer must NOT load material above the top edge (rim) of the dumpster. Materials must lie below the FILL LINE marked on the container. Overfilled dumpsters may be refused at pickup and incur the $150 Excess Fill charge.

3.2.2 Weight Distribution.

Material must be distributed evenly throughout the container to prevent unsafe transport conditions. Top-heavy or unbalanced loads will be refused at pickup.

3.2.3 Heavy Material Limits.

For heavy inert material (concrete, sod, dirt) in the 10-Yd HD unit, the dumpster may NOT be filled above the marked half-fill line. This is a safety requirement to stay within truck weight limits.

3.2.4 Equipment Damage.

The Customer is responsible for any physical damage to the dumpster caused by misuse (cuts, dents, fire damage, hazardous material contamination). Damage repair charges range from $150 to $2,500 depending on severity.

3.3 Rental Period & Pickup
3.3.1 Rental Period Calculation.

The standard 7-Day rental begins on the date of delivery and ends 7 calendar days later. Monthly rentals run 30 days from delivery.

3.3.2 Pickup Notification.

The Customer must notify KYN at least 24 hours in advance for pickup. Same-day pickup is subject to availability and may incur an additional charge.

3.4 Weight & Overage
3.4.1 Weight Measurement.

Weight is measured at the certified landfill scale. The Customer will be provided with a copy of the scale ticket on request.

3.4.2 Automatic Charges.

Overage charges apply automatically based on the actual tonnage in the load over the included weight allowance.

3.4.3 Prohibited Item Penalties.

If the load contains prohibited items that the landfill refuses, the $250 Landfill Rejection Fee applies in addition to any costs associated with re-routing the load to an alternative disposal facility.

3.5 Liability & Indemnification
3.5.1 Customer Liability.

The Customer assumes all liability for personal injury, property damage, or third-party claims arising from the use of the dumpster on the Customer's property during the rental period.

3.5.2 Indemnification.

The Customer agrees to indemnify and hold harmless KYN Hauling LLC, its owners, employees, and agents from all claims related to use of the dumpster, including injuries to the Customer's family, guests, employees, or contractors.

3.5.3 Property Damage Limits.

KYN is not responsible for damage to driveways, lawns, sprinkler systems, septic systems, underground utilities, or landscaping that results from normal delivery and pickup operations.

3.5.4 Property Authorization.

The Customer warrants that they own the property at the delivery address or have authorization from the owner to place a dumpster there. KYN is not liable for disputes between the Customer and property owners.

3.6 Payment & Collections
3.6.1 Payment Terms.

Payment is due at the time of delivery for standard residential customers. Approved contractor accounts may have Net-15 or Net-30 terms.

3.6.2 Late Payment Charges.

Past-due accounts are subject to a 1.5% per month finance charge (18% annual) and may be referred to a collections agency.

3.6.3 Collection Costs.

The Customer is responsible for all costs of collection, including reasonable attorney's fees, court costs, and collection agency fees.

3.6.4 Returned Payments.

Returned payments (NSF, stopped payment, or chargebacks) incur a $50 fee per occurrence in addition to the original amount owed. Persistent failed payments may result in account suspension.

3.6.5 Credit Card Surcharge.

Credit card payments (Visa, MasterCard, American Express, Discover) are subject to a 3% processing surcharge to offset merchant processing fees, disclosed at booking and itemized on the receipt. Payments by ACH, check, or cash are not subject to this surcharge.

3.6.6 Damage Deposit.

A refundable $200 damage deposit may be charged for monthly rentals or other high-risk rental types at KYN's discretion. The deposit is refunded after pickup provided no prohibited materials are found, no property damage occurred, and no other policy violations are present. KYN may waive the deposit at its sole discretion for established customers with a good payment history.

3.6.7 Lien Rights.

KYN Hauling LLC reserves the right to pursue all available legal remedies for unpaid balances, including filing a claim of lien against the property at the delivery address in accordance with applicable Florida law. The Customer's obligation to pay all charges survives the termination or completion of the rental agreement. KYN's exercise of lien rights does not waive any other available remedies, including civil judgment, collections referral, or reporting to credit bureaus.

3.6.8 Applicable Taxes.

Rental charges and service fees may be subject to applicable Florida state and local sales tax as required by law. Any taxes due will be disclosed at booking and itemized on the receipt or invoice. KYN Hauling LLC collects and remits applicable taxes in accordance with Florida Department of Revenue guidelines.

3.7 Governing Law & Disputes
3.7.1 Florida Law.

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

3.7.2 Venue.

Any dispute arising under this Agreement shall be resolved in the courts of Sarasota County, Florida.

3.7.3 Severability.

If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.

3.7.4 Entire Agreement.

This Terms & Conditions document, together with the signed Rental Agreement and Pickup Condition Report (if any), constitutes the entire agreement between KYN and the Customer regarding the rental.

3.7.5 Pre-Dispute Written Notice Requirement.

Before filing any claim, lawsuit, or initiating any legal or administrative proceeding against KYN Hauling LLC, the Customer must first provide KYN with written notice of the dispute by certified mail or email to [email protected], describing the nature of the complaint and the remedy sought. KYN shall have thirty (30) calendar days from receipt to investigate and attempt resolution. This requirement does not extend any applicable statute of limitations, but the 30-day resolution period shall be excluded from any limitations calculation. This applies to all claims, including billing disputes, property damage claims, and service complaints.
